The Corporate Manslaughter and Corporate Homicide Act 2007 should not have a significant effect on those companies who take their Health and Safety responsibility seriously.However we believe that even the best companies may not have taken on the implications of this Act in relation to "Road Risk" particularly if their employees driving activity is not a core part of their business but an ancillary or peripheral necessity. It may well be that the first time this is considered is when an employee has been killed whilst driving at work or has killed someone else whilst driving at work.
 
The risks to employers will increase when the 48 hour opt out of the Working Time Regulations is removed imminently.

The HSE estimate that up to a third of all road traffic accidents involve somebody who is at work at the time. This may account for over 20 fatalities and 250 serious injuries every week!! A company which has "Road Risk Policies" and a compliance regime in place should have no difficulty in answering the following queries:

Do your employees know the driving for work policies?
 
Have your employees driving ability (and therefore risk) been assessed?
Is their collision rate monitored and action taken?
Do you know that their driving licence is current and valid?
What compliance processes and sanctions are in place?
What should a driver do if travelling long distances and becomes tired, particularly if at night and away from home?
What if a driver is attending a meeting that is critical to the company but the weather is bad and Police are advising, through the media that people should not travel?

Incidentally it is strongly suspected that with the proliferation of speed cameras that many "law abiding", otherwise responsible drivers, have obtained a "duplicate" driving licence prior to disqualification and continue to drive although disqualified. It is highly likely that even their partners are unaware of this!!
